Terms of Service — Kimp

These Terms govern your use of Kimp (“the App”). By downloading or using the App, you agree to these Terms.
If you do not agree, do not use the App.
1) About Kimp
Kimp is an educational app that helps you discover artworks and practice what you learned using review features (spaced repetition).
The App is provided for informational and educational purposes. We try to keep content accurate, but we do not guarantee that artwork metadata (dates, attributions, descriptions) is complete, up to date, or error-free.
2) Eligibility
Kimp is intended for a general audience and is not directed to children under 13.
If you are under the age of majority where you live, you may use the App only with a parent or guardian’s permission.
3) No account
Kimp does not require an account. Your learning data is primarily stored on your device. Some features require an internet connection (for example fetching daily artwork content).
4) License and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
You agree not to:
- use the App in a way that violates any applicable law or regulation,
- reverse engineer, decompile, or attempt to extract source code except where permitted by law,
- circumvent paywalls, quotas, or access controls,
- interfere with or disrupt the App or its infrastructure (including abuse, scraping, or denial-of-service).
5) Apple App Store terms (important)
If you downloaded the App from Apple’s App Store:
- These Terms are between you and the developer, not Apple.
- Apple has no obligation to provide support or maintenance for the App.
- To the extent permitted by law, Apple is not responsible for claims relating to the App (including product liability, consumer protection, or IP infringement claims).
- Apple and its subsidiaries are third-party beneficiaries of these Terms for App Store downloads and may enforce these Terms against you.
Your use may also be subject to Apple’s applicable usage rules and the Apple standard end-user license agreement (EULA) if you have not been provided a separate EULA in App Store Connect.
6) Kimp+ subscription (auto-renewable)
Kimp offers paid subscriptions (“Kimp+”) that unlock premium features.

- Yearly subscription
Billing and renewal
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription in your Apple ID subscription settings.
- If you cancel, you keep access until the end of the paid period.
Price changes and refunds
- If pricing changes, Apple’s rules for notice and consent apply.
- Refund requests are handled by Apple under Apple’s policies.
7) Free-plan limits and changes
The free version includes limits (for example a rolling 30-day cap on newly learned artworks). Limits, premium features, and the App’s functionality may change over time.
We may change, suspend, or discontinue parts of the App at any time.
8) Content and intellectual property
The App
The App’s software, design, and trademarks are owned by us or our licensors and are protected by applicable laws.
Artwork images and metadata
Artwork images and metadata may come from public domain sources and Wikimedia and other public datasets. Rights may belong to their respective owners or may be subject to specific licenses/attribution requirements.
Unless explicitly stated, we do not grant you a license to reuse third-party artwork images outside the App.
Copyright concerns / takedown
If you believe content in the App infringes your rights, contact support@kimp.app with sufficient details so we can investigate (identify the content, the right you claim, and what you want us to do).
9) Feedback
If you send feedback (ideas, suggestions, or bug reports), you grant us the right to use it without restriction or compensation, unless prohibited by law.
10) Disclaimer of warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions (including parts of the EU) do not allow certain disclaimers. Nothing in these Terms limits rights you cannot legally waive.
11) Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill.
Where liability cannot be excluded, it is limited to the amount you paid (if any) for the App in the 12 months before the claim, or the minimum required by law (whichever is higher).
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer protections.
12) Termination
You may stop using the App at any time. We may suspend or terminate your right to use the App if you materially violate these Terms.
Sections that by their nature should survive termination will survive (for example intellectual property, disclaimers, limitation of liability).
13) Governing law and consumer rights
These Terms are governed by applicable laws, excluding conflict-of-law rules.
If you are a consumer in the EU, you may benefit from mandatory consumer protections in your country of residence, and you may be able to bring claims in your local courts where required by law.
14) Changes to these Terms
We may update these Terms. If changes are material, we will update the effective date and make the updated Terms available in-app and/or on our website.
By continuing to use the App after the effective date of updated Terms, you agree to the updated Terms.
